Terms of Service

The 40LOVE websites, related mobile applications and services (collectively, the "Services") are made available to you by DROP SHOT APPS Ltd with its address at 15 Ringford Road, London, SW18 1RP subject to these Terms of Service and in accordance with the 40LOVE Privacy Policy. You agree to comply with these Terms and any supplemental terms which 40LOVE makes available to you on the Services. BY ACCESSING, USING OR UPLOADING OR DOWNLOADING ANY INFORMATION OR MATERIALS TO OR FROM THE SERVICES, OR BY CREATING AN ACCOUNT, YOU ARE AGREEING TO THESE TERMS.

Registration and Accounts

The Services are intended solely for persons who are 13 years old or such higher age required in your country to use the Services. To use the Services, you must register. You agree to:

  • Provide true, accurate, current and complete information about yourself.
  • Maintain and promptly update your Member Data.
  • Maintain the confidentiality of your password and restrict access to your account.
  • Immediately notify 40LOVE of any unauthorised use of your account or any other breach of security.

Member Content and Conduct

You own the information, data, text, photographs and other materials you make available in connection with the Services. You grant 40LOVE a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any Content that you post on or in connection with the Services. The Services are for your personal and noncommercial use. You may not engage in the following Prohibited Activities:

  • Copying, framing or mirroring any part of the Services.
  • Accessing the Services to monitor its availability, performance or functionality for competitive purposes.
  • Permitting any third party to access the Services on your behalf.
  • Reverse engineering, decompiling or attempting to extract the source code of the software underlying the Services.
  • Publishing, transmitting or storing content that is illegal, obscene, defamatory, threatening or hateful.
  • Using the Services to send unsolicited communications (spam).
  • Impersonating any person or entity or falsely stating your affiliation with any person or entity.

40LOVE Rights

All right, title and interest in and to the Services (excluding Content provided by members) are and will remain the exclusive property of 40LOVE and its licensors. The Services are protected by copyright, trademark, and other laws. Nothing in these Terms gives you a right to use the 40LOVE name or any of the 40LOVE trademarks, logos, domain names, and other distinctive brand features.

Subscriptions and Payments

Some Services require payment of fees. All fees are stated in pounds sterling (GBP) and are exclusive of VAT unless otherwise stated. You agree to pay all applicable fees in connection with your subscription. 40LOVE reserves the right to change its fees at any time upon notice. If you do not agree to a fee change, you may cancel your subscription before the change takes effect.

Termination

You may terminate your account at any time. 40LOVE may terminate or suspend your access to the Services immediately, without prior notice, if you breach these Terms or for any other reason at 40LOVE's sole discretion. Upon termination, your right to use the Services will immediately cease.

Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, 40LOVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. IN NO EVENT SHALL 40LOVE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
